A sensa\u00e7\u00e3o \u00e9 que existem solicita\u00e7\u00f5es e exig\u00eancias incans\u00e1veis de serem cumpridas e, \u00e9 por esse, dentre outros motivos, que o produtor rural precisa estar sempre atento e listar todas as necessidades legais de uma propriedade rural.<\/p>\n\n\n\n<p>Quanto a regulariza\u00e7\u00e3o ambiental, o primeiro passo legal perante os \u00f3rg\u00e3os ambientais \u00e9 o <strong>Cadastro Ambiental Rural (CAR)<\/strong>, a principal ferramenta prevista na legisla\u00e7\u00e3o ambiental para a adequa\u00e7\u00e3o ambiental das propriedades rurais, conserva\u00e7\u00e3o do meio ambiente e monitoramento de \u00e1reas em restaura\u00e7\u00e3o.<\/p>\n\n\n\n<p>No estado de Mato Grosso, o <strong>CAR<\/strong> \u00e9 gerenciado pelo Sistema de Cadastro Ambiental Rural <strong>(SIMCAR)<\/strong>, ferramenta pr\u00f3pria que se encontra em sincroniza\u00e7\u00e3o com o Sistema Federal <strong>(SICAR)<\/strong>. Os cadastros re\u00fanem informa\u00e7\u00f5es das propriedades, como o quantitativo de Vegeta\u00e7\u00e3o Nativa <strong>(AVN)<\/strong>, Reserva Legal <strong>(RL)<\/strong>, exist\u00eancia de \u00c1rea Consolidada <strong>(AC)<\/strong>, \u00c1reas de Preserva\u00e7\u00e3o Permanente <strong>(APP)<\/strong>, \u00c1reas de Uso Restrito <strong>(AUR)<\/strong>, entre outros.<\/p>\n\n\n\n<p>O <strong>CAR<\/strong> \u00e9 obrigat\u00f3rio para todo e qualquer im\u00f3vel rural, independe do seu tamanho ou regi\u00e3o e, o n\u00e3o cadastramento, dentre outros preju\u00edzos, impede o produtor de aderir ao <strong>Programa de Regulariza\u00e7\u00e3o Ambiental<\/strong> <strong>(PRA)<\/strong>, deixando de obter benef\u00edcios previstos para regulariza\u00e7\u00e3o do im\u00f3vel, bem como impede a obten\u00e7\u00e3o de financiamentos banc\u00e1rios, e at\u00e9 mesmo inviabiliza a comercializa\u00e7\u00e3o da produ\u00e7\u00e3o.<\/p>\n\n\n\n<p>As obriga\u00e7\u00f5es previstas no C\u00f3digo Florestal com rela\u00e7\u00e3o ao <strong>CAR<\/strong> s\u00e3o de responsabilidade do propriet\u00e1rio ou posseiro e, o Decreto&nbsp;Federal&nbsp;7.830\/2012 disp\u00f5e que o <strong>CAR<\/strong> deve ser declarado por parte do propriet\u00e1rio&nbsp;rural&nbsp;ou posseiro, ou at\u00e9 mesmo por um representante legalmente constitu\u00eddo.<\/p>\n\n\n\n<p>Sendo assim ap\u00f3s a inser\u00e7\u00e3o do <strong>CAR<\/strong>, al\u00e9m de documenta\u00e7\u00f5es pessoais, o \u00f3rg\u00e3o ambiental ir\u00e1 analisar a dominialidade correspondente na parte cadastral, somente ent\u00e3o passando a observar os pontos ambientais, identificando a tipologia vegetal da \u00e1rea e verificando se a reserva legal preenche o percentual estabelecido pela legisla\u00e7\u00e3o, levantando tamb\u00e9m se h\u00e1 demais passivos ambientais. Ap\u00f3s isso, o \u00f3rg\u00e3o ambiental emite um parecer com ou sem pend\u00eancias. Se o parecer aprovou as informa\u00e7\u00f5es declaradas e houve a valida\u00e7\u00e3o do <strong>CAR<\/strong>, sem que o im\u00f3vel apresentasse passivos, o mesmo estar\u00e1 regularizado.<\/p>\n\n\n\n<p>Os im\u00f3veis que possu\u00edrem passivos ambientais relativos \u00e0 \u00c1rea de Preserva\u00e7\u00e3o Permanente <strong>(APP)<\/strong>, \u00c1rea de uso restrito e Reserva Legal <strong>(RL)<\/strong> poder\u00e3o aderir ao <strong>PRA<\/strong> para regularizarem seus im\u00f3veis e, ap\u00f3s a assinatura e publica\u00e7\u00e3o do Termo de Compromisso Ambiental <strong>(TCA)<\/strong> ainda ser\u00e3o considerados im\u00f3veis em regulariza\u00e7\u00e3o, bem como os que ainda n\u00e3o tiveram o <strong>CAR<\/strong> analisado. Lembrem-se, segundo o C\u00f3digo Florestal, excetuados alguns casos, todo im\u00f3vel rural deve manter \u00e1rea com cobertura de vegeta\u00e7\u00e3o nativa, a t\u00edtulo de Reserva Legal, com percentuais m\u00ednimos em rela\u00e7\u00e3o \u00e0 \u00e1rea do im\u00f3vel, sendo eles: \u00a080% em \u00e1rea de florestas; 35% em \u00e1rea de cerrado e 20% em \u00e1rea de campos gerais, para im\u00f3veis localizados na Amaz\u00f4nia Legal, j\u00e1 nas demais regi\u00f5es do Pa\u00eds: 20%.<\/p>\n\n\n\n<p>Por Dra.
