Assim como outros provimentos editados nos \u00faltimos anos, insere-se em um processo cont\u00ednuo de aperfei\u00e7oamento normativo, sucedendo e atualizando disposi\u00e7\u00f5es anteriores para adequar o regramento \u00e0s demandas contempor\u00e2neas. Fruto de um processo institucional de observa\u00e7\u00e3o e experimenta\u00e7\u00e3o meticulosa no \u00e2mbito do Laborat\u00f3rio de Inova\u00e7\u00e3o (LIODS\/CNJ), esse ato normativo apresenta mecanismos como o Sistema de Informa\u00e7\u00f5es Geogr\u00e1ficas do Registro de Im\u00f3veis (SIG-RI) e o Invent\u00e1rio Estat\u00edstico Eletr\u00f4nico do Registro de Im\u00f3veis (IERI-e), concebidos para aprimorar a organiza\u00e7\u00e3o, fiscaliza\u00e7\u00e3o e interpreta\u00e7\u00e3o da malha fundi\u00e1ria nacional.<\/p>\n<div class=\"quote-wrapper right\">\n<p class=\"quote-content\"><span style=\"font-size: 16px;\"><strong>Mais que uma mera atualiza\u00e7\u00e3o tecnol\u00f3gica, a medida reafirma o compromisso do sistema registral com os princ\u00edpios constitucionais da publicidade, da seguran\u00e7a jur\u00eddica e da fun\u00e7\u00e3o social da propriedade.<\/strong> Nesse contexto, destaca-se a altera\u00e7\u00e3o procedimental relativa \u00e0 retifica\u00e7\u00e3o de \u00e1rea de im\u00f3veis urbanos e rurais, notadamente a possibilidade de dispensa da anu\u00eancia dos confrontantes, antes exig\u00eancia recorrente e, muitas vezes, entrave \u00e0 regulariza\u00e7\u00e3o.<\/span><\/p>\n<\/div>\n<p>Conforme o artigo 440-AX, \u00a7 3\u00ba, do novo Provimento, a anu\u00eancia do confinante \u00e9 dispensada em duas situa\u00e7\u00f5es: (i) quando o im\u00f3vel e seu confrontante j\u00e1 se encontram certificados pelo Incra, nos moldes do \u00a7 5\u00ba do art. 176 da Lei de Registros P\u00fablicos (Lei n\u00ba 6.015\/1973); ou (ii) quando o im\u00f3vel confrontante for bem p\u00fablico, como rios naveg\u00e1veis, lagos, estradas ou ferrovias, desde que respeitadas as faixas de dom\u00ednio e as \u00e1reas de preserva\u00e7\u00e3o previstas em lei. Essa previs\u00e3o tende a simplificar o procedimento, resultando em maior celeridade, redu\u00e7\u00e3o de custos, amplia\u00e7\u00e3o do acesso ao cr\u00e9dito rural e est\u00edmulo \u00e0 formaliza\u00e7\u00e3o de \u00e1reas produtivas.<\/p>\n<p>Por um lado, a medida representa al\u00edvio para produtores rurais, sobretudo em estados com vasta extens\u00e3o territorial e elevado n\u00famero de propriedades com pend\u00eancias documentais, como o Mato Grosso. Por outro, demanda aten\u00e7\u00e3o para que n\u00e3o se converta em instrumento de fragiliza\u00e7\u00e3o de direitos leg\u00edtimos.<\/p>\n<p>Outro ponto sens\u00edvel refere-se \u00e0 capacidade t\u00e9cnica das serventias extrajudiciais. Embora o Provimento imponha aos registradores o dever de an\u00e1lise cr\u00edtica dos pedidos de retifica\u00e7\u00e3o, incluindo o encaminhamento ao ju\u00edzo competente nos casos de d\u00favida fundamentada (art. 205-Q), o volume de demandas, a car\u00eancia de pessoal qualificado e a insufici\u00eancia de estrutura t\u00e9cnica em muitas comarcas do interior podem comprometer a efetividade dessa salvaguarda.<\/p>\n<p>Para o produtor rural, que h\u00e1 d\u00e9cadas enfrenta um emaranhado de exig\u00eancias para manter seu im\u00f3vel regularizado, a expectativa \u00e9 de um processo mais \u00e1gil e seguro. Ainda assim, a moderniza\u00e7\u00e3o n\u00e3o assegura, por si s\u00f3, a justi\u00e7a fundi\u00e1ria. A retifica\u00e7\u00e3o, mesmo em sua forma simplificada, deve respeitar a boa-f\u00e9, a fun\u00e7\u00e3o social, o direito de propriedade e os direitos de terceiros. Cabe aos registradores, magistrados, advogados e demais profissionais do campo jur\u00eddico zelar para que as mudan\u00e7as sirvam \u00e0 regulariza\u00e7\u00e3o leg\u00edtima, e n\u00e3o \u00e0 formaliza\u00e7\u00e3o de pr\u00e1ticas irregulares.<\/p>\n<p>O Provimento n\u00ba 195\/2025, portanto, pode inaugurar uma fase promissora na gest\u00e3o dos registros imobili\u00e1rios no Brasil. A integra\u00e7\u00e3o entre sistemas, a precis\u00e3o t\u00e9cnica e a elimina\u00e7\u00e3o de burocracias infundadas s\u00e3o metas leg\u00edtimas.
